Terms of Use and Sale

These Terms of Use and Sale (“Terms”) govern the use of the Pole Cards mobile application (“App”) and the contractual relationship between Anne-Claire Ho Si (“we”, “us”) and any person using the App or purchasing a subscription through it (“you”).

By downloading, installing, or using the App, or by purchasing a subscription, you agree to be bound by these Terms.

1. Purpose

The Pole Cards App allows users to create, organize, and view moves, track their progress, and access a curated selection of external educational content.

2. User Accounts

• You must provide accurate information, including a valid email and a secure password.
• You are responsible for all activity under your account.

3. Subscriptions and Commercial Terms

3.1 Price and duration

• Subscription: €8.99 per month (including VAT).
• Trial period: 7 days free.
• Automatic monthly renewal unless canceled before the renewal date.
• We may change the subscription price in the future. If we do, you will be notified in advance, and the change will apply from your next billing cycle unless you cancel before the change takes effect.

3.2 Payment terms

• Payments are processed by Apple App Store and Google Play Store via RevenueCat.
• Cancellation must be made directly from your Apple or Google account settings.
• No partial refunds are provided for early termination of the subscription period.

3.3 Included content and features

• The free version provides access to moves, images, and videos shared within the App, subject to applicable rights.
• The paid version includes advanced features: creation of custom moves, combo creation, progress tracking, and search/curation tools.
• The availability of external videos is not guaranteed in the long term, as their access depends on third-party integrations beyond our control.

4. External Content and Intellectual Property

• The App may include links or integrations to videos, images, or other content from third parties.
• We claim no intellectual property rights over such content and redirect to the original sources, crediting creators when possible.
• Access to such content is subject to the terms of the third-party sites and may be modified or removed at any time.

5. User-Generated Content

• You may add moves, images, and videos, but you guarantee that you have the necessary rights to use and share them.
• By publishing within the App, you grant us a worldwide, non-exclusive, royalty-free license to display and share such content within the scope of the App.
• Prohibited content includes offensive, discriminatory, illegal content, or material that infringes the rights of others.
• We reserve the right to remove any content at our sole discretion.

6. App Intellectual Property

• All content in the App, excluding user-generated content and external content, is the exclusive property of Anne-Claire Ho Si.
• Any unauthorized reproduction, distribution, or modification is prohibited.

7. Right of Withdrawal (EU Consumers)

7.1 Statutory right

Under EU consumer law, you have a legal right to withdraw from your purchase within 14 days without giving any reason.

7.2 Waiver of withdrawal right for digital services

By purchasing a subscription to the App, you expressly agree that:

• The service will begin immediately upon purchase (including during the trial period, if applicable).
• You lose your right of withdrawal once the service has started in full, as the digital content/service is made fully available to you immediately.

This waiver is in accordance with Article L221-28 of the French Consumer Code and Directive (EU) 2011/83.

8. Changes to the App

• We reserve the right to modify, add, or remove features, including those included in paid subscriptions, in order to improve the service or for technical, legal, or contractual reasons.
• Such changes do not constitute a lack of conformity as long as the App retains its main features as described in Article 3.3.

9. Termination

• We may suspend or terminate your access if you violate these Terms.
• You may cancel your subscription via your App Store before the renewal date.

10. Warranties and Liability

• The App is provided “as is”.
• We do not guarantee uninterrupted access or permanent availability of external content.
• We are not liable for any damages resulting from the use or inability to use the App.

11. Governing Law and Jurisdiction

• These Terms are governed by French law.
• Any dispute will be submitted to the competent courts within the jurisdiction of the Paris Court of Appeal.
